Associate – Employment Law at CMS Poland (Kraków)
CMS Poland is expanding its Employment Law practice in Kraków, operating from the Equal Business Park complex in the Podgórze district, one of Kraków's fastest-growing business areas near the Vistula River. The Kraków office serves the growing number of SSC/BPO/IT companies establishing operations in the city.
About the Role
You will advise employers on all aspects of Polish employment law under the Kodeks pracy (Labour Code), including employment contracts, collective agreements, trade union relations, and workplace restructurings. The role covers contentious and non-contentious work: representing employers before Sąd Pracy (Labour Courts) in dismissal disputes and discrimination claims, as well as advising on complex employment aspects of M&A transactions (TUPE transfers under Art. 23-1 Kodeks pracy).
You will also advise on the engagement of workers through civil law contracts (umowa zlecenia, umowa o dzieło) and the growing regulatory scrutiny from the Państwowa Inspekcja Pracy (PIP) around misclassification. The Kraków office handles significant work for technology companies, shared service centres, and manufacturing clients in the Małopolska region.
Responsibilities
- Advise employers on all aspects of individual and collective employment law under the Kodeks pracy
- Represent employers in labour court proceedings (Sąd Pracy) in Kraków and surrounding jurisdictions
- Draft employment contracts, workplace regulations (regulaminy pracy), and collective bargaining agreements
- Advise on employment aspects of M&A transactions and workforce restructurings
- Handle PIP inspections and ZUS compliance matters
- Advise technology and SSC clients on flexible working arrangements and civil law contract compliance
Requirements
- Qualified adwokat or radca prawny with 3-5 years of experience in employment law
- Thorough knowledge of the Kodeks pracy, collective labour law, and trade union regulations
- Experience representing employers in Sąd Pracy proceedings
- Understanding of employment aspects of M&A (Art. 23-1 KP) and restructurings
- Familiarity with PIP inspection procedures and social security (ZUS) compliance
- Fluent Polish and English; German useful for CMS network
