Position Overview
Job Description
Linklaters Germany is seeking a Rechtsanwalt to join our Restructuring and Insolvency practice in Munich. You will advise creditors, debtors, and investors on complex restructuring situations, insolvency proceedings, and distressed M&A transactions in the German and European market.
Responsibilities
- Advise on formal insolvency proceedings under the InsO including Eigenverwaltung and Schutzschirmverfahren
- Support out-of-court restructurings and StaRUG proceedings
- Advise creditors on security enforcement and insolvency challenges (Insolvenzanfechtung)
- Assist with distressed M&A transactions and asset deals from insolvency estates
- Draft and negotiate restructuring plans and standstill agreements
- Advise on directors' duties and liability in situations of financial distress
Requirements
- Zweites Staatsexamen with Praedikatsexamen preferred
- 2-5 years of experience in restructuring, insolvency, or banking law
- Admitted as Rechtsanwalt in Germany
- Thorough knowledge of InsO, StaRUG, and German insolvency law
- Understanding of financial restructuring concepts and credit documentation
- Fluent in German and English
- Fachanwalt fuer Insolvenzrecht qualification is advantageous
