Job Description

The FNE is hiring a mid-level Merger Control associate for its Santiago office. The role involves reviewing merger notifications under Chile's mandatory pre-merger control regime (introduced by Ley 20.945 in 2016), conducting competitive effects analysis, and negotiating merger remedies to preserve competition in concentrated markets.

Chile's merger control system requires mandatory notification for transactions exceeding CLP revenue thresholds. The associate will analyse mergers across mining, retail, financial services, telecommunications, and healthcare sectors, applying economic tools to assess unilateral and coordinated effects in Chilean markets.

Responsibilities

  • Reviewing merger notifications and conducting competitive assessment under DL 211 and Ley 20.945
  • Analysing market definition, market shares, and competitive effects of proposed transactions
  • Conducting Phase I preliminary reviews and recommending Phase II in-depth investigations
  • Negotiating structural and behavioural remedies with merging parties
  • Preparing decision documents and TDLC consultation requests
  • Coordinating with international competition authorities on multi-jurisdictional merger reviews

Requirements

  • Licenciatura en Ciencias Juridicas and juramento ante la Corte Suprema
  • 3-6 years of experience in competition law, M&A, or regulatory law
  • Knowledge of DL 211, Ley 20.945 (merger control reform), and FNE merger guidelines
  • Understanding of economic analysis tools: market definition, HHI, UPP, and competitive effects assessment
  • Experience with merger filings, Phase I/Phase II reviews, and remedy negotiation
  • English proficiency for OECD and ICN coordination
