Position Overview
Job Description
The Fiscalia Nacional Economica (FNE), Chile's national competition authority, seeks a Senior Cartel Investigation lawyer for its Santiago headquarters. The role involves leading investigations into horizontal anti-competitive agreements (carteles), bid-rigging in public procurement, and hub-and-spoke arrangements across Chile's key economic sectors including retail, pharmaceutical, poultry, and construction.
Chile's competition enforcement has been transformed by the landmark colusion de pollos and colusion de farmacias cases. The FNE brings cases before the Tribunal de Defensa de la Libre Competencia (TDLC) under DL 211. The successful candidate will conduct dawn raids, manage leniency applications under the delacion compensada programme, and prepare cases for prosecution before the TDLC.
Responsibilities
- Leading cartel investigations from preliminary inquiry through TDLC prosecution
- Conducting dawn raids and managing the preservation of electronic and documentary evidence
- Administering leniency applications under the delacion compensada programme
- Preparing requerimientos (formal complaints) for filing before the TDLC
- Coordinating with international competition authorities on cross-border cartel investigations
- Contributing to FNE policy development and competition advocacy initiatives
Requirements
- Licenciatura en Ciencias Juridicas and juramento ante la Corte Suprema
- 7-11 years of experience in competition law, antitrust, or regulatory enforcement
- Deep knowledge of DL 211, TDLC jurisprudence, and Chile's leniency programme (delacion compensada)
- Experience with cartel investigations, dawn raids, and evidence analysis
- Understanding of economic analysis in competition cases (market definition, effects analysis)
- English proficiency for coordination with ICN and OECD competition networks
