Avocat Senior en Droit Minier — Lexel Juridique & Fiscal
Lexel Juridique & Fiscal is seeking an experienced Avocat Senior en Droit Minier to lead the firm's mining law practice in Antananarivo. With the mining moratorium lifted in January 2026, Madagascar's extractive sector is experiencing a surge of new investment and regulatory activity. This senior role involves advising mining companies, exploration permit holders, and government stakeholders on all aspects of Madagascar's Code Minier and related environmental regulations.
The successful candidate will manage complex mining permit applications before the Bureau du Cadastre Minier de Madagascar (BCMM), negotiate concession agreements, and represent clients before the Tribunal de Commerce d'Antananarivo. You will work closely with international mining companies seeking to establish or expand operations in Madagascar, providing strategic counsel on regulatory compliance, community engagement obligations, and environmental impact assessments under the Charte de l'Environnement.
This is a partnership-track position offering significant autonomy, client development opportunities, and the chance to shape Madagascar's mining legal landscape during this critical period of sector reopening.
Responsibilities
- Lead all mining law mandates for the firm, from exploration permits to production licenses
- Advise clients on compliance with the Code Minier and post-moratorium regulatory changes
- Draft and negotiate mining concession agreements, joint venture structures, and royalty arrangements
- Represent clients before the Tribunal de Commerce, Cour d'Appel, and administrative tribunals
- Manage relationships with the BCMM, Ministry of Mines, and environmental regulatory bodies
- Conduct due diligence on mining assets and advise on M&A transactions in the extractive sector
- Supervise junior avocats and paralegals working on mining matters
- Contribute to business development and client relationship management
Requirements
- CAPA certification (Certificat d'Aptitude à la Profession d'Avocat) and active membership in the Barreau d'Antananarivo
- Minimum 8 years of experience practicing mining or natural resources law in Madagascar
- Deep knowledge of Madagascar's Code Minier, Code de l'Environnement, and BCMM procedures
- Experience advising on large-scale mining projects (nickel, cobalt, ilmenite, graphite)
- Fluency in French and Malagasy; English proficiency strongly preferred
- Master's degree in law (Maîtrise en Droit) from the University of Antananarivo or equivalent
- Strong relationships with mining regulatory bodies and the Malagasy judiciary
- Experience with international arbitration (ICC, ICSID) is a significant advantage
