Job Description

Senior Legal Officer (Regulatory Enforcement) — Financial Services Commission

The Financial Services Commission (FSC) of Mauritius, the integrated regulator for the non-banking financial services sector and Global Business, seeks a Senior Legal Officer for its Enforcement Division at FSC House, Ebene Cybercity. The FSC regulates over 25,000 Global Business entities, making its legal team one of the busiest regulatory enforcement functions in any offshore jurisdiction.

The Senior Legal Officer will lead enforcement actions against non-compliant licensees, investigate financial misconduct, draft regulatory directions, and represent the FSC before the Supreme Court of Mauritius and the Financial Services Review Panel. The role encompasses the Financial Services Act 2007, the Securities Act 2005, the Insurance Act 2005, and the Virtual Asset and Initial Token Offering Services Act 2021 — covering the full breadth of Mauritius's financial services regulatory architecture.

Responsibilities

  • Lead regulatory enforcement actions against non-compliant Global Business licensees
  • Investigate financial misconduct and prepare enforcement recommendations for the Board
  • Draft regulatory directions, show-cause notices, and licence revocation decisions
  • Represent the FSC before the Supreme Court of Mauritius and the Financial Services Review Panel
  • Advise on the interpretation and application of the Financial Services Act 2007 and subsidiary legislation
  • Draft new regulations and contribute to the FSC's rulemaking function

Requirements

  • Barrister admitted by the Mauritius Bar Council with minimum 7 years' post-admission experience
  • Strong litigation and regulatory enforcement background
  • Deep knowledge of the Financial Services Act 2007, Securities Act 2005, and Insurance Act 2005
  • Experience with regulatory investigations, enforcement proceedings, or prosecutions
  • Understanding of the VAITOS Act 2021 and emerging fintech regulation
  • LL.B. from a recognised institution; LL.M. in financial regulation or securities law preferred
  • Bilingual English and French required
