Job Description

The Comision para el Mercado Financiero (CMF), Chile's integrated financial regulator, seeks a Senior Banking Supervision lawyer for its Santiago headquarters. The role involves leading the legal aspects of on-site and off-site supervision of Chile's banking sector, reviewing prudential compliance with the Ley General de Bancos, and advising on enforcement actions against non-compliant financial institutions.

Chile's banking sector — dominated by institutions such as Banco de Chile, Banco Santander Chile, BCI, and Itau Corpbanca — is undergoing transformation with Basel III implementation, open banking under Ley 21.521, and the emergence of digital banking challengers. The role requires a lawyer who can navigate the intersection of prudential regulation, consumer protection, and financial innovation.

Responsibilities

  • Leading on-site examinations and supervisory reviews of Chilean banks and financial institutions
  • Advising on enforcement actions, administrative sanctions, and corrective measures against non-compliant institutions
  • Reviewing banks' compliance with Basel III capital adequacy, liquidity, and leverage requirements
  • Advising on banking resolution planning and early intervention frameworks
  • Contributing to the development of CMF normativa and circulares for the banking sector
  • Coordinating with international regulators and the Basel Committee on Banking Supervision

Requirements

  • Licenciatura en Ciencias Juridicas and juramento ante la Corte Suprema
  • 8-12 years of experience in banking regulation, financial supervision, or financial services law
  • Deep knowledge of Ley General de Bancos (DFL 3 de 1997), CMF normativa, and Basel III framework
  • Experience with regulatory enforcement, administrative sanctions, and banking resolution
  • Understanding of Ley 21.521 (Ley Fintech) and digital banking regulation
  • English proficiency for Basel Committee and international regulatory coordination
