The SQE Pathway for Foreign Lawyers

Since September 2021, the Solicitors Qualifying Examination (SQE) has become the primary route for foreign lawyers seeking to qualify as solicitors in England and Wales. The SQE replaced both the Qualified Lawyers Transfer Scheme (QLTS) and the traditional LPC pathway.

What Foreign Lawyers Need to Do

  • Pass SQE1: Two multiple-choice assessments (360 questions total) covering core legal knowledge in English and Welsh law
  • Pass SQE2: Practical skills assessments including legal research, writing, client interviewing, and advocacy
  • Complete Qualifying Work Experience (QWE): Two years of legal work, which can include experience gained in your home jurisdiction if it involved English or Welsh law, or work done in the UK
  • Meet the SRA's character and suitability requirements

Foreign lawyers with significant experience may find that their existing legal knowledge covers much of the SQE1 syllabus, though additional study on English-specific areas (such as land law, constitutional law, and the English court system) is typically required.

The QLTS — Historical Context

The Qualified Lawyers Transfer Scheme (QLTS) was the previous route for foreign lawyers to qualify as solicitors in England and Wales. It was replaced by the SQE in September 2021. If you previously passed part of the QLTS, the SRA has transitional arrangements — check the SRA's website for the latest guidance on your specific situation.

Registered Foreign Lawyer (RFL) Status

If you do not wish to fully qualify as an English solicitor, you can apply to become a Registered Foreign Lawyer (RFL). RFL status allows you to:

  • Practise in England and Wales under your home jurisdiction's qualification
  • Work at law firms regulated by the SRA, including as a partner or member of an LLP
  • Advise on your home jurisdiction's law and on international matters
  • Use the title 'Registered Foreign Lawyer'

RFLs cannot hold themselves out as solicitors of England and Wales and cannot conduct reserved legal activities (such as exercising rights of audience in court) unless they also hold English qualification. However, RFL status is widely used by international lawyers working at London offices of global firms.

To register as an RFL, you must be qualified to practise law in your home jurisdiction and meet the SRA's character and suitability requirements.

Post-Brexit Changes for EU-Qualified Lawyers

Before Brexit, lawyers qualified in EU member states could register as Registered European Lawyers (RELs) in England and Wales, practise under their home title, and after three years of UK practice could qualify as English solicitors without taking transfer exams.

Since the UK's departure from the EU, this route is no longer available for new applicants. EU-qualified lawyers who were already registered as RELs before 1 January 2021 retain their status. New EU-qualified lawyers wishing to practise in the UK must now use the SQE pathway or register as an RFL, on the same basis as lawyers from any other non-UK jurisdiction.

Scottish Qualification

Scotland has its own legal system and qualification process. Foreign lawyers wishing to qualify as Scottish solicitors should contact the Law Society of Scotland, which has its own admission and assessment requirements. Qualification as an English solicitor does not automatically confer the right to practise Scots law, and vice versa — though there are transfer mechanisms between the two jurisdictions.

Visa and Immigration Requirements

Foreign lawyers coming to the UK will typically need a visa. The main immigration routes for legal professionals are:

  • Skilled Worker Visa (formerly Tier 2): The most common route for foreign lawyers offered employment in the UK. Requires a Certificate of Sponsorship from an employer that holds a Sponsor Licence. Solicitors, barristers, and legal professionals are on the eligible occupations list. Minimum salary thresholds apply (currently £38,700 for most roles, though going-rate exceptions may apply)
  • Global Talent Visa: For lawyers with exceptional talent or promise, particularly those recognised as leaders in their field
  • Graduate Visa: For international students who have completed a UK degree — allows two years of post-study work (three years for PhD graduates)
  • Youth Mobility Scheme: Available to nationals of certain countries aged 18–30, allowing up to two years of work in the UK

  • Step 1: Determine your goal — full English qualification (SQE) or practise under your existing qualification (RFL)

  • Step 3: If seeking employment, begin applying to firms and check whether they offer visa sponsorship
  • Step 4: Register with the SRA as either a solicitor (after passing SQE and completing QWE) or as an RFL
  • Step 5: Consider joining professional networks such as the International Bar Association (IBA) or the Law Society's International Division
