Job Description

The New York City Taxi and Limousine Commission (TLC) is the City agency responsible for regulating for-hire transportation in New York City, including taxis, street hail liveries, high-volume for-hire services such as Uber and Lyft, black cars, luxury limousines, livery vehicles, commuter vans, and paratransit vehicles.

The TLC oversees a transportation ecosystem that moves nearly 1 million riders every single day the equivalent of the entire Boston transit system. TLC is the agency responsible for regulating New York City's taxicab and for-hire vehicle industry. With approximately 180,000 licensed drivers, 1,000 businesses, 115,000 vehicles including and the iconic yellow taxi at the heart of our city’s identity, TLC is entering a new era of dignity, accountability, and collaboration across the for hire vehicle sector. TLC continues to be on the front lines of a rapidly changing mobility landscape and our innovative efforts--whether requiring minimum pay for app drivers, ensuring wheelchair accessible service, making our licensed fleet more environmentally sustainable, working to eliminate traffic fatalities, or preventing discriminatory service--often serve as a model for other cities.

The Prosecution Division investigates and prosecutes violations of the New York City Administrative Code and TLC Rules arising from administrative, field, and consumer-initiated complaints. Attorneys handle a diverse and challenging caseload involving reckless driving, unlicensed operation, illegal street hails, harassment, leaving the scene of an accident, fraud, consumer protection, and other matters affecting public safety.

This position offers an outstanding opportunity for attorneys particularly those beginning their litigation careers to develop substantial courtroom advocacy experience from the outset. Prosecuting Attorneys manage their own caseloads, regularly appear before Administrative Law Judges at the Office of Administrative Trials and Hearings (OATH), examine witnesses, introduce evidence, negotiate settlements, draft legal pleadings and appeals, and make independent prosecutorial recommendations under the guidance of experienced supervisors. Through rotations in Consumer Intake, Settlements, Hearings, Appeals, and specialized enforcement assignments, attorneys gain broad, practical litigation experience and develop the advocacy, negotiation, and legal writing skills that serve as a strong foundation for a successful legal career.

Duties and responsibilities include, but are not limited to:
Under the supervision of experienced attorneys, managing a caseload and representing the Taxi and Limousine Commission at administrative hearings, including preparing cases, examining witnesses, introducing documentary evidence, and presenting legal arguments before Administrative Law Judges, as well as negotiating settlements with respondents and/or their representatives; assisting Prosecuting Attorneys with Port Authority summonses issued in connection with Port Authority's airport enforcement of the impermissible solicitation regulations under Sections 19-506 and 19-507 of the New York City Administrative Code; assisting prosecutors with the Division's enforcement of unlicensed for-hire vehicle activity, including prosecuting vehicle seizure matters, filing civil vehicle forfeiture proceedings, and coordinating with investigative and enforcement personnel to ensure appropriate regulatory action; evaluating the strengths and weaknesses of cases to negotiate fair and effective plea agreements and settlements with respondents, attorneys, and other representatives; interviewing consumer complainants and witnesses to investigate allegations, assess credibility, determine appropriate charges, and recommend case resolutions; reviewing hearing decisions, identifying legal and factual issues, and drafting appeals, Chair Petitions, and other post-hearing submissions when appropriate; collaborating with investigators, enforcement officers, and agency staff to develop cases, analyze evidence, and advance matters involving public safety and regulatory compliance; conducting legal research, analyzing statutes, rules, and case law, and preparing written memoranda and recommendations on complex legal and policy issues.

Note:
New Hire Rate: $72,510
After two (2) years of city employment: $83,388

Qualifications

Graduation from an accredited United States law school as defined in the Rules of the New York Court of Appeals (Sections 520.3 or 520.5) or admission to the New York State Bar.
